These Terms of Service (“Terms”) govern your access to and use of artefactcurator.com (the “Site”) and any purchases you make from Artefact Curator (“Artefact Curator,” “we,” “us,” “our”). By using the Site or placing an order, you agree to these Terms.

If you do not agree, do not use the Site or purchase from us.

2) Products and Intended Use

Artefact Curator products are designed for indoor use only unless explicitly stated otherwise on a product page.

Indoor-use-only means: avoid outdoor exposure, moisture, rain, sprinklers, high humidity, salt air, and direct weather. Using products outside or in damp environments may cause discoloration, corrosion, warping, or premature wear and may affect warranty coverage.

You are responsible for selecting appropriate placement, installation method, and displayed items, and for confirming the wall type/structure can safely support the product and your display.

3) Orders and Acceptance

When you place an order, you are making an offer to buy. We may accept, reject, or cancel orders at our discretion, including for inventory issues, pricing errors, suspected fraud, shipping limitations, or other reasons.

If we cancel an order after payment, we will issue a refund to the original payment method.

4) Pricing, Taxes, and Payment

Prices are shown in USD unless stated otherwise. Prices may change without notice.

You agree to provide current, complete, and accurate payment and billing information. You authorize us (or our payment processor) to charge your payment method for your order total, including taxes and shipping if applicable.

5) Shipping and Delivery

Shipping methods, costs, and estimated delivery windows are shown at checkout or on the product page.

Estimated delivery dates are not guarantees.
Once a package is transferred to the carrier, delivery timing is outside our control.
You are responsible for providing an accurate shipping address. If a package is returned due to address issues, you may be responsible for reshipment fees.

Risk of loss passes to you upon delivery to the carrier or upon delivery confirmation (depending on applicable law). If your shipment arrives damaged, notify us promptly as described in Section 9.

6) Pre-Orders and Backorders (If Applicable)

If a product is listed as pre-order or backorder, your order may ship at a later date. Estimated ship dates may change. If timelines change materially, we will update you and, where required, offer cancellation options consistent with these Terms.

7) Returns and Exchanges

We want you to be confident in your purchase. Return eligibility and timeframes (if any) are defined by our Return Policy, which is incorporated into these Terms by reference.

Return Policy:

Returned items must be unused, uninstalled, and in original condition/packaging.
Original shipping fees are typically non-refundable.
You may be responsible for return shipping unless the return is due to our error.

8) One-Year Limited Warranty (Structural Components)

Unless a product page states otherwise, we provide the following limited warranty:

One-Year Limited Warranty: We warrant that structural components are free from defects in materials and workmanship for one (1) year from the date of delivery, when used under normal indoor conditions.

If a covered component fails under normal indoor use during the warranty period, we will, at our option:

repair the component,
replace the component, or
refund the purchase price of the component.

This warranty does not cover:

Normal wear and tear, scratches, patina, cosmetic changes, or finish aging
Damage from misuse, accidents, abuse, improper installation, or alteration
Outdoor use, moisture/humidity exposure, or corrosive environments
Damage caused by displayed items (overloading, improper objects, instability)
Natural materials (including botanicals/branches) that vary and change over time
Minor variations in color, texture, grain, or finish that are inherent to the product

To request warranty support, contact us at sales@artefactcurator.com with your order number, a description of the issue, and clear photos.

9) Damaged, Defective, or Incorrect Items

If your item arrives damaged, defective, or incorrect, contact us within 14 days of delivery at sales@artefactcurator.com and include:

Order number
Photos of the item and packaging
A brief description of the issue

We may require inspection, additional photos, or return of the item/packaging to process a claim.

10) Installation and Safety Disclaimer

You are responsible for:

Proper installation and securing of wall-mounted products
Using appropriate anchors/hardware for your wall type
Confirming the installation surface is structurally sound
Safe placement to avoid tipping, impact, or contact with children/pets

We are not responsible for damage, injury, or loss resulting from improper installation, misuse, or unsafe placement.

If you are unsure, hire a qualified installer.

11) Intellectual Property

All content on the Site (text, photography, product designs, graphics, logos, and other materials) is owned by or licensed to Artefact Curator and protected by intellectual property laws. You may not copy, reproduce, distribute, or exploit our content without written permission.

12) User Content (If You Share Photos/Reviews)

If you submit reviews, photos, or other content (“User Content”), you grant Artefact Curator a non-exclusive, worldwide, royalty-free license to use, reproduce, publish, and display that content for marketing and promotional purposes (including on our Site and social media), unless you explicitly request otherwise in writing.

You represent that you own or have permission to share any User Content you provide.

13) Prohibited Uses

You agree not to:

Use the Site for unlawful purposes
Attempt to interfere with Site security or functionality
Scrape, reverse engineer, or misuse Site content or systems
Submit false, misleading, or infringing content

14) Disclaimer of Warranties

Except as stated in the limited warranty above, the Site and products are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all other warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose.

15) Limitation of Liability

To the fullest extent permitted by law, Artefact Curator will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from or related to your use of the Site or products.

Our total liability for any claim will not exceed the amount you paid for the specific product giving rise to the claim.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

16) Indemnification

You agree to indemnify and hold Artefact Curator harmless from claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Site, your violation of these Terms, or your infringement of any rights of a third party.

17) Governing Law; Dispute Resolution; Binding Arbitration

These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles.

Before starting any arbitration or legal proceeding, you agree to first contact Artefact Curator and attempt to resolve the dispute informally. You must send a written notice describing the dispute, the order involved, your requested resolution, and your contact information. Artefact Curator will have 30 days to respond and attempt to resolve the matter informally.

If the dispute cannot be resolved informally, you and Artefact Curator agree that any dispute, claim, or controversy arising out of or relating to these Terms, your use of the website, your purchase of products, or your relationship with Artefact Curator will be resolved by binding individual arbitration, rather than in court, except as stated below.

The arbitration will be administered by the American Arbitration Association under its applicable Consumer Arbitration Rules, unless the parties agree otherwise in writing. The arbitrator will have the authority to resolve the dispute and award any relief available under applicable law.

You and Artefact Curator agree that arbitration will take place on an individual basis only. You may not bring a claim as a plaintiff or class member in a class action, collective action, representative action, private attorney general action, or any other consolidated proceeding. The arbitrator may not consolidate more than one person’s claims or preside over any class, collective, representative, or consolidated proceeding.

You and Artefact Curator each waive the right to a jury trial and the right to have disputes decided by a judge in court, except for matters that may be brought in small claims court or as otherwise required by law.

Either party may bring an individual claim in small claims court in Napa County, California, if the claim qualifies for small claims court and remains only in that court.

Unless the parties agree otherwise, arbitration will take place in Napa County, California, by telephone, by video conference, or based on written submissions, as determined by the arbitrator and the applicable arbitration rules.

If any part of this arbitration agreement is found to be invalid or unenforceable, the remaining parts will remain in effect to the fullest extent permitted by law. If the class action waiver is found to be invalid or unenforceable as to a particular claim, then that claim must proceed in court and not in arbitration.

Any permitted legal action that is not subject to arbitration or small claims court must be brought in the state or federal courts located in Napa County, California, unless applicable law requires otherwise.

18) Changes to These Terms

We may update these Terms from time to time. The “Last Updated” date will change when we do. Your continued use of the Site after updates means you accept the revised Terms.
